Who does the settlement affect?

On August 31, 2022 the Supreme Court of Newfoundland and Labrador approved a settlement on behalf of the following people:

  1. All former residents who suffered sexual abuse by operators, managers, administrators, teachers, and staff, or a fellow resident, while residing at either the Whitbourne Training School, the Pleasantville Training School, or the St. John’s Youth Centre between May 1, 1973 and June 28, 1989;
    1. The above institutions are also known as:
      1. Whitbourne Training School: the Whitbourne Youth Centre, the Boys’ Home, the Boys’ Home and Training School, and the Whitbourne School for Boys.
        1. The Pleasantville Training School: the Girls’ Home, the Girls’ Home and Training School, and the Pleasantville School for Girls (at different times, this institution was in Torbay and St. John’s)

       

  1. The individual is ordinarily a resident in Newfoundland and Labrador, and they did not opt-out of the class proceeding. If an individual is not ordinarily a resident in Newfoundland and Labrador, then they must have opted-in to the class proceeding; and
  1. Lived until May 10, 2022.

 

What is in the settlement?

  • $12.5 million in compensation to eligible individuals which will be distributed to each eligible claimant based on a points system allocated to each claim after considering the nature and impact of the abuse.
  • Below is the maximum amount a class member may receive based on their claims level:
    • Track 1: $50,000
    • Track 2A: $500,000
    • Track 2B: $500,000.

 

What do I have to do and by when?

In order to qualify for compensation, class members must submit a claims application on or before October 9, 2023.  To submit a claim, visit the class action website.
