THE DEADLINE TO SUBMIT A CLAIM IS OCTOBER 25, 2024.

A lawsuit alleges that certain models of LG Refrigerators (Covered Models) suffer from a defect that can cause them to stop cooling. The term No-Cooling Event means any event when your Covered Model LG Refrigerator failed to maintain temperature levels necessary to preserve food, beverages, medicine, or other perishables. 

None of the allegations made in the lawsuit have been proven and LG Electronics Canada, Inc. (LG Canada) has not been found liable for any of the claims raised in this lawsuit. The parties have instead proposed a settlement in order to avoid lengthy litigation 

Who does the settlement affect? 

The settlement was approved on behalf of the following people: 

Canadian resident who purchased, from LG Canada or an authorized retailer, other than for resale, a Covered Model of LG Refrigerator produced between January 30, 2014, and May 27, 2024. Some exceptions apply. 

The Covered Models of LG Refrigerators are listed below.

* The asterisk next to each Covered Model number indicates the colour suffix that attaches to a model number. 

You must have experienced a No-Cooling Event within two years of purchase to be eligible for compensation. If there were multiple No-Cooling Events the rest of them other than the first must have occurred within three years of the purchase. 

The harms eligible for compensation include: 

  1. you paid for parts or labour to have your Covered Model repaired; 
  2. you had multiple repairs; 
  3. you had delayed repairs; 
  4. you suffered property loss or property damage, including any flooring damage, spoiled food, beverages, medicine, or other perishables attributable to a No-Cooling Event with your Covered Model; and/or, 
  5. you disposed of or replaced your Covered Model because of one or more No-Cooling Events. 

 

What is in the settlement? 

This is a claims-based settlement where there is no fixed amount the defendant is paying. The total amount will depend on the number of eligible claimants and how much there are found to be entitled to by the Claims Administrator, Epiq Class Actions Services Canada. 

There are two options for class members:

  1. Default Payment where you do not need to submit additional proof and can be eligible for up to $150 ($50 for out-of-pocket labour costs for repair and/or up to $100 for property loss, such as spoiled food or other damage); or
  2. Alternative Payment which requires additional proof such as receipts or invoices but are eligible for larger compensation amounts 

 

For the harms mentioned you could earn up to: 

Labour Costs  Up to $259 for labour costs incurred in connection with repairs for a No-Cooling Event within 2 years of purchase 
Delayed repairs  Up to $700 for repairs ONLY by a LG ‘directly managed mobile service technician’ or authorized third party repair provider after a No-Cooling Event within the 2 years of purchase (The list of ‘Authorized repair service providers’ is found below) 

 

Delays not caused by LG however will not count towards the calculation of compensation 

Multiple repairs  Up to $1000 for experiencing 2+ unsuccessful repairs by either the LG authorized or authorized third party repairers after a first No-Cooling Event. If you have one No-Cooling event after the failed fix, the payment is $100. 

 

$300 if there are two failed repairs 

$1000 if there are three failed repairs 

Property Loss  Up to $2,500 for property loss or damage from a No-Cooling Event including loss of food, ruined flooring value… 
Replacement of LG refrigerator  $650 if fridge was replaced or disposed within two years of purchase following a No-Cooling Event  

 

*you can only also apply for the Property Loss Payment or Default Property Loss Payment with this option 

Payment for Parts  If you replaced and repaired parts related to the cooling system (includes compressor, condenser, connection tube, drier, evaporator) following No-Cooling Event within 2 years of purchase, you can get up-to full reimbursement for the parts

What do I have to do and by when? 

Each claimant must fill out the claim form in full to be RECEIVED by the claim’s administrator by October 25, 2024. 

Evidence that may be required includes: receipts, invoices, photographs, payment card records, inspection records, insurance records, or any other available proof of the harms described above.
